Birleşmiş Milletler Çocuk Hakları Sözleşmesi’nin 12. maddesi, bütün çocuklara, kendilerini etkileyen her konuda dinlenilme ve çocuğun yaşına ve olgunluk düzeyine göre düşüncelerine gereken özenin gösterilmesi hakkını tanımaktadır. Madde metninde “katılım” terimi zikredilmemiş olmasına rağmen, genel olarak bu hak, katılım hakkı olarak adlandırılmıştır. 12. maddede güvence altına alınan katılım hakkı, Sözleşmenin temel ilkelerinden birisini oluşturmaktadır. Bu nedenle, 12. madde ile sadece bir hak güvence altına alınmamış, aynı zamanda Sözleşme ile çocuklara tanınan diğer hakların uygulanmasında da göz önünde bulundurulması gereken temel bir değer kabul edilmiştir. Katılım hakkının güvence altına alınmasındaki temel amaç, çocukların ve genç bireylerin demokratik ilkeleri anlamasını ve hayatlarının her alanında bu ilkelerin uygulanmasını sağlamak konusunda taraf devletlerin teşvik edilmesidir.
Article 12 of the UN Convention on the Rights of the Child assures the right of all children to be heard in all matters affecting them with due weight being afforded their views in accordance with their age and maturity. This right is generally named as participation, even the term “participation” is not mentioned within the text of Art.12. Right to participation guaranteed by Art. 12 is a general guiding principle of the Convention.Thus, Art.12 does not only sets the foundation of a right but it also specifies a fundamental value that should be considered in the implementation of all rights belonging to the child. The main objective of the guarantee provided for right to participation is to encourage States Parties to create opportunities for children and young people to understand and apply democratic principles in all areas of their lives.
