Female pathways to recidivism after domestic violence in Türkiye

Özet

Domestic violence represents a significant public health issue, both in terms of its association with gender inequality and its impact on social problems such as criminalization. Despite evidence indicating the role of domestic violence in female pathways at crime, there is a notable research gap concerning the recidivism processes of women in conflict with the law and the strategies employed at the national level to address this issue. The present article is the first study to examine the experiences of domestic violence among women in conflict with the law in T & uuml;rkiye, with a focus on recidivism and the impact of the criminal justice system. For this purpose, indepth interviews were conducted with thirteen women under probation using a phenomenological research design. The results demonstrate that women in conflict with the law perceive the processes and outcomes resulting from their disadvantaged social circumstances to be shaped by gendered structural power relations. Concurrently, these conditions are regarded as the constraining element of an unending cycle, whereas the coping mechanism establishes the routes that lead to the criminalization process. Therefore, the criminalization and criminal justice involvement processes should be understood, and their gender-specific needs addressed, to prevent recidivism after the criminal justice process. These findings highlight the need to not only address the causes of crime from a traditional perspective, but also to develop our understanding of the crimes that women perceive as a coping mechanism against violence, the social conditions of disadvantage, the complex structure and solutions to crimes.
