Özet
Türk-İsviçre hukukunda fark hipotezinin, masrafları kapsar biçimde modifiye edilmiş hali, zararın fark hipotezinden bağımsız eski hale iade konsepti çerçevesinde ele alınmasını, yani düalist zarar konseptinin gelişimini geciktirmiştir. İsviçre Federal Mahkemesinin ağaç zararı kararları sonrasında, eski hale iade-değerince tazmin ikiliği, İsviçre öğretisinde zarar ve tazminat hukuku literatüründe görünür olmaya başlamıştır. Tazminat hukukunun pek çok probleminin kaynaklandığı bu olgusal ikilik, Alman hukukunda olduğu gibi teorik ve ilkesel düzlemde kabul edilmekle, onarım-ikame ve tedavi masraflarına ilişkin değerlendirmeler, aslında bunları zaten kapsayıp açıklamayan fark hipotezinden ayrı biçimde, eski hale iade (restitution) başlığı altında, kendi sınırları ve kendi değer yargısı olan bütünlük menfaati çerçevesinde daha sağlıklı biçimde yürütülebilecektir.
In Turkish-Swiss law, the modified version of the difference hypothesis, extended to cover expenses, has delayed the treatment of damage within the framework of restitution independent of the difference hypothesis, and thus the development of a dualist concept of damage. Following the Swiss Federal Court’s decisions on tree damage, the duality of restitution / compensation in value began to gain visibility in Swiss doctrine and in the literature on the law of damages and compensation. If this factual duality, which lies at the root of many problems in the law of damages, is recognized at the theoretical and principled level as in German law, assessments concerning repair, replacement, and medical costs can be carried out more coherently under the heading of restitution, separate from the difference hypothesis that in fact neither encompasses nor adequately explains them, and within the framework of the integrity interest, with its own boundaries and normative content.
