Özel idari kolluk faaliyeti olan yapı denetimi, mal ve can güvenliğinin korunması bakımından önemlidir. Fenni mesuller, kamu adına söz konusu denetimi gerçekleştirmektedir. Projenin denetimiyle göreve başlayan fenni mesul, yapı ruhsatı alınmasında ve ardından yapım aşamasında da önemli görevler üstlenmektedir. Yapı denetimi Hakkında Kanun kapsamının dışındaki yapılarda yapı denetimine ilişkin fennî mesuliyeti kural olarak İmar Kanunu hükümleri çerçevesinde mimar ve mühendisler üstlenmektedir. Söz konusu Kanun kapsamındaki yapılarda ise yapı denetim kuruluşları da fenni mesuliyeti üstlenmektedir. Yapı denetim kuruluşları ile söz konusu kuruluşlarda görevli denetçi mimar ve mühendisler İmar Kanunu’nda yer alan fenni mesuliyete ilişkin düzenlemelere tabidir. Çalışmamızda imar kolluk yetkisi bağlamında yapı denetimi kavramı, ardından fenni mesulün hukuki statüsü, temel görevleri ve fenni mesule uygulanabilecek başlıca idari yaptırımlar incelenmektedir.
Building inspection, which is a special administrative law enforcement activity, is important in terms of protecting the safety of life and property. Technically liable persons conduct building inspection on behalf of the public. They begin their duties with project supervision and also play significant roles in obtaining the building permit and afterwards during the construction phase. For buildings that are not covered by the Code on Building Inspection, technical liability for building inspection isheld by architects and engineers in accordance with Zoning Act, as a rule. In buildings subject to the Code on Building Inspection, building inspection organizations assume technical liability. The building inspection organization and its inspector architects and engineers are subject to the technical liabilities’ provisions of the Zoning Act in terms of their actions and procedures. In this study, the concept of building inspection in the context of zoning law enforcement activity, then the legal status and basic duties of technically liable persons and the main administrative sanctions that can be imposed to technically liable persons are being examined.
