Özet
Kasten yaralama sonucu ölüme neden olma suçunda, ölüm neticesinin faile isnat edilebilmesi için nedensellik bağlantısı ile objektif isnat edilebilirliğin tespit edilmesi gerekmektedir. Şart teorisinin oluşturduğu sorumluluk alanının sınırsızlığı, kusur incelemesine geçilmeden önce tipikliğin objektif unsurları yönünden bir sınırlama yapılmasını gerekli kılmaktadır. Normatif kurallara dayanan bu sınırlama, objektif isnadiyet teorisi aracılığıyla gerçekleştirilir. Bununla birlikte neticesi sebebiyle ağırlaşmış suçların, diğer suç tiplerine nazaran önemli ölçüde ağırlaştırılmış cezalar ile yaptırım altına alınmış olması nedeniyle bu suçlardan doğan sorumluluğun, temel suç tipine bağlı olarak daha katı bir biçimde sınırlandırılması gerektiği konusunda görüş birliği bulunmaktadır. Buna yönelik olarak Alman Federal Mahkemesi tarafından suç tipine özgü tehlike bağlantısı kuralı ortaya atılmış; ancak bu kuralın amaca uygun biçimde uygulanması konusunda tutarlı bir yaklaşım sergilenememiştir. Çalışmada öncelikle şart teorisine göre nedensellik kavramı incelenmiş; ardından suç tipine özgü tehlike bağlantısı, neticesi sebebiyle ağırlaşmış suçlara özgü bir isnat edilebilirlik unsuru olarak objektif isnadiyet teorisinin ilke ve esasları çerçevesinde ele alınmıştır.
In the crime of aggravated battery causing death, in order for the result of death to be imputed to the perpetrator, the causal link and objective imputation must be determined. The unlimited area of responsibility created by the theory of conditions necessitates a limitation in terms of the objective elements of typicality before proceeding to the examination of fault. This limitation based on normative rules is realised through the theory of objective imputation. However, since aggravated crimes are sanctioned with significantly aggravated penalties, there is a consensus that the liability arising from these crimes should be limited more strictly. To this end, the German Federal Court has introduced the rule of danger connection specific to the type of offence; however, a consistent approach has not been demonstrated in the application of this rule in accordance with the purpose. In this study, firstly, the concept of causation according to the theory of conditions has been analysed; then, the danger connection specific to the type of offence has been discussed within the framework of the basics and principles of the objective imputation theory as an element of imputability specific to crimes aggravated by the consequences.
